Overview
These Terms and Conditions ("Terms") set out the rules that apply to every purchase made through the online shop at xtanloy.com between XTANLOY ("we", "us") and you ("Buyer"). Our range covers products across the home and garden categories.
For the purposes of these Terms, a consumer is any individual entering into a legal transaction for purposes that fall outside their trade, business, craft, or profession. A business buyer is any person or entity acting within the framework of their commercial or self-employed capacity when concluding the contract.
Any conflicting, differing, or supplementary conditions proposed by the Buyer form part of the agreement only where we have expressly acknowledged them in writing.

How the Contract Comes Into Being
The display of our products within the online shop does not amount to a legally binding offer, but rather an invitation for you to place an order.
By pressing the "Buy" / "Place order" / "Pay now" button, you make a binding offer to purchase the items listed in your shopping basket.
Confirmation of receipt and acceptance of your order happen at the same moment — both are sent to you shortly after order submission by way of an automatically generated email. Upon the sending of that confirmation email, the sales contract becomes legally binding.
We store the contract text and forward it to you together with these Terms by email. The current version of these Terms is also available at any time at xtanloy.com/terms-of-service.
Contracts are concluded in the English language.
Prices and Delivery Charges
All prices displayed on the website include the applicable statutory Value Added Tax. Any additional shipping and delivery charges are shown separately throughout the ordering process.
For deliveries to countries outside the European Union and the United Kingdom, further customs duties, import taxes, and additional charges may apply, all of which are payable by the Buyer.

Payment Methods
The following payment methods are accepted: credit card (Visa, Mastercard, American Express), PayPal, Klarna, Apple Pay, Google Pay, and bank transfer. We reserve the right, in specific cases, not to offer particular payment methods.
The purchase price becomes payable upon conclusion of the contract.
When paying by credit card or PayPal, the amount is charged to your payment account immediately upon order completion.
Delivery
Delivery is made to the address supplied by the Buyer. Specific delivery times are clearly indicated on each product page and throughout the ordering process.
Should delivery prove impossible despite three attempts, we are entitled to withdraw from the contract. In such an event, any payments already received shall be refunded to you without delay.
Where delays result from force majeure, delivery times shall be extended accordingly. We shall notify you of any such delay promptly.
Retention of Ownership
The goods delivered remain our property until the purchase price has been paid in full.
Consumer Right of Cancellation
Consumers benefit from a statutory right of cancellation. Full information about this right, together with the model cancellation form, is available on our Cancellation Policy page.
Warranty and Liability for Defects
The statutory rules on liability for defects apply. For consumers, the limitation period for claims arising from defective goods is two years from the date of delivery.
For second-hand goods, this limitation period is shortened to one year from the date of delivery.

Liability
We accept unlimited liability in cases of intent and gross negligence, and within the scope of consumer protection legislation.
In cases of simple negligence, our liability is limited to breach of a material contractual obligation (known as a cardinal duty), whose fulfilment is essential for proper performance of the contract and on whose observance the Buyer routinely relies. In such situations, liability is capped at the level of foreseeable damages typical of the contract.
The above shall not affect our liability for injury to life, body, or health.
Dispute Resolution
The European Commission operates an Online Dispute Resolution (ODR) platform, accessible at https://ec.europa.eu/consumers/odr.
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration body.
Applicable Law and Jurisdiction
The contractual relationship shall be governed exclusively by the laws of England and Wales, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. In respect of consumers, this choice of law applies only insofar as the protection afforded by mandatory provisions of the law of the country of the consumer's habitual residence is not thereby withdrawn.
If the Buyer is a merchant, a legal person under public law, or a special fund under public law, the place of our registered office shall be the place of jurisdiction for all disputes arising from this contractual relationship.
Final Provisions
Should any provision of these Terms prove wholly or partly invalid, the validity of the remaining provisions shall remain unaffected. Any invalid provision shall be replaced by the corresponding statutory rule.
